“Diva Pawule Wasanawa” – Consumer Promotion

Terms & Conditions

  1. All employees of Hemas Holdings PLC and its subsidiaries and associate companies (the “Hemas Group”), and immediate relations (i.e. parents, spouse & children, siblings) of employees, advertising agencies, public relations consultants and their immediate families and any other party related to this Consumer Promotion are strictly ineligible to participate in the Consumer Promotion.

 

  1. Promotion Period: The Consumer Promotion will commence on 15th of July 2025 and the end date will be communicated on mass media and social media pages of Diva Sri Lanka. Entries received outside this stipulated period will be automatically disqualified without further notice or recourse.

 

 

  1. Prizes and Draws
    1. The promotion offers the following gifts to consumers based on the respective pack sizes, submitted determined by a draw
      1. One Diva Fresh 1kg Pack
        1. One (01) Vehicle as the Grand Prize (Motor Car – Toyota Wigo) – One Winner (the make, model specifications and colour of the Vehicle are subject to Hemas sole discretion and the availability) at the time of the prize fulfilment. Hemas reserves the right to substitute the vehicle with another of comparable value if the advertised vehicle is unavailable.
        2. Total 6 Winners for Fully Automatic Top Load Washing machines during the promotion period (the make, model, specifications colours are subject to Hemas sole discretion and the availability at the time of the prize fulfilment).
        3. Total 6 Winners for Televisions during the promotion period (the make, model, specifications colours are subject to Hemas sole discretion and the availability at the time of the prize fulfilment)

  1. Draw Dates:
    1. Daily Draw Dates: –Daily prize winners selection will commence from 31st July 2025. Winners for the preceding 15 days from 15th July 2025 to 31st July 2025 will be selected on the 31st July 2025. End Date will be notified in due course

 

  1. WEEKLY Draw Dates: – Weekly starting from 31st July 2025. End Date will be notified in due course

 

  • Monthly Draw Dates: – Monthly starting from 15th August 2025. End Date will be notified in due course

 

  1. Grand Prize Draw Dates: – At the end of the campaign period which is to be notified in due course

 

 

  1. Draw Integrity

The selection of all winners for the Consumer Promotion will be conducted via a draw held at a location determined solely by Hemas Manufacturing Private Limited. The decision/s of Hemas Manufacturing (Pvt) Ltd pertaining to all matters in connection with the Consumer Promotion, including without limitation, to the interpretation of these Terms and Conditions and the draw results, shall be final and binding on all participants and shall not be disputed. Hemas reserves the right to conduct the draw in a manner it deems appropriate to ensure fairness and transparency.

 

 

  1. Prize Conditions and Exclusions
    1. All prizes, including the Motor Car (Toyota Wigo), are non-transferable and cannot be exchanged for cash, monetary value, or any other goods or services.
    2. Hemas Manufacturing Private Limited shall not be responsible for insuring the Motor Car (Toyota Wigo), or bearing any other additional expenses related to the car, including but not limited to registration fees, service costs, fuel, maintenance, or any modifications. These costs shall be the sole responsibility of the prize winner from the point of handover.
  • Tax Liability: For the avoidance of doubt, all taxes, duties, levies, charges, and any other statutory payments whatsoever, whether imposed by the Government of Sri Lanka or any other authority, in relation to the receipt, ownership, transfer, or gifting of any prize (including but not limited to income tax, stamp duty, transfer tax, or any other applicable taxes on the vehicle or other gifts) shall be the sole responsibility of the respective prize winner. Hemas shall not be liable for any such taxes or expenses. Winners are strongly advised to seek independent professional tax advice regarding their prize.
  1. Eligibility for Grand Prize: Previous prize winners (i.e., daily, weekly, or monthly prize winners) are explicitly NOT eligible for the Grand Prize (Motor Car – Toyota Wigo) with the same entry that won them a previous prize.
  2. Entry Removal: Entries that have been drawn and selected as winners for any prize will be removed from all future draws to ensure fairness and opportunity for other participants.

 

 

  1. Publicity and Data Usage and Consent to Personal Data Processing:

By submitting an entry to this Consumer Promotion, each participant (“Data Subject”) hereby explicitly and unconditionally consents to the collection, use, storage, processing, and sharing of their personal information by Hemas Manufacturing (Pvt) Ltd (“Data Controller”) for the purposes outlined below, in accordance with the provisions of the Personal Data Protection Act, No. 9 of 2022 (PDPA) of Sri Lanka.

  1. Types of Personal Information Collected: Hemas Manufacturing (Pvt) Ltd may collect and process personal information provided in the entry, including but not limited to, name, contact details (phone number, email address, postal address), National Identity Card (NIC) number, and any other information voluntarily provided by the participant. For winners, this may also include photographic images, video footage, and testimonials.
  2. Purposes of Data Processing: The personal information collected will be used and processed for the following specific purposes:
    1. To administer and manage the “Diva Pawule Wasanawa” Consumer Promotion, including verifying eligibility, conducting draws, notifying winners, and facilitating prize fulfillment.
    2. To communicate with participants regarding their entry status, prize collection, and any other related promotional matters.
    3. For Publicity and Advertising: Hemas Manufacturing (Pvt) Ltd reserves the right to use the names, photographs, likenesses, voices, and testimonials of all participants, and specifically winners, in any and all media now known or hereafter devised, including but not limited to print advertisements, digital media (e.g., websites, emailers), and social media platforms (e.g., Facebook, Instagram, YouTube), for advertising, marketing, and promotional purposes related to this Consumer Promotion and other Hemas brands, without further compensation or notification to the participant/winner, unless prohibited by law. By submitting an application, participants acknowledge and consent to Hemas Manufacturing (Pvt) Ltd taking pictures and/or videos of winners during prize handovers or related events and posting such content across its various communication channels.
    4. To analyze promotional effectiveness and for internal reporting purposes.
    5. To comply with any applicable laws, regulations, legal processes, or governmental requests.
    6. For future marketing communications from Hemas Manufacturing (Pvt) Ltd regarding its products, services, and other promotions, unless the participant explicitly opts out by following the unsubscribe mechanism provided in such communications.
  • Data Sharing: Hemas Manufacturing (Pvt) Ltd may share personal information with its affiliated companies, trusted third-party service providers (such as advertising agencies, event organizers, logistics partners), and regulatory authorities, strictly for the purposes outlined in this clause and under appropriate confidentiality agreements.
  1. Data Storage and Security: Personal information will be stored securely and retained for a period necessary to fulfill the purposes for which it was collected, or as required by law. Hemas Manufacturing (Pvt) Ltd will implement appropriate technical and organizational measures to protect personal data against unauthorized or unlawful processing and against accidental loss, destruction, or damage.
  2. Participant’s Rights: Participants have certain rights under the PDPA, including the right to access, rectify, or withdraw their consent regarding their personal data, subject to legal limitations. Requests regarding personal data should be directed to Hemas Data Protection Officer. Withdrawal of consent may affect participation in the promotion or prize fulfillment if the processing is essential for these activities.

 

  1. Limitation of liability and General Provisions

 

  1. By participating in the Consumer Promotion, each and every participant unconditionally agrees to these Terms and Conditions and shall accede to be bound by the decision/s of Hemas Manufacturing (Pvt) Ltd pertaining to all matters in connection with the Consumer Promotion, including without limitation, to the interpretation of these Terms and Conditions. For the purpose of clarity, each person by way of participating in the Consumer Promotion agrees to accept the decisions of Hemas Manufacturing (Pvt) Ltd as final and binding, and the same shall not be disputed during the subsistence of the Consumer Promotion and thereafter.
  2. Hemas Manufacturing (Pvt) Ltd reserves the right, at its sole discretion, to disqualify any entry or participant found to be tampering with the entry process or the operation of the promotion, or to be acting in violation of these Terms and Conditions or in an unsportsmanlike or disruptive manner.
  • Hemas Manufacturing (Pvt) Ltd shall not be responsible for any entries that are lost, misdirected, incomplete, illegible, or not received for any reason, including but not limited to technical failures, postal delays, or any other circumstances beyond its reasonable control.
  1. Hemas Manufacturing (Pvt) Ltd reserves the right to amend, suspend, or terminate the Consumer Promotion, or amend these Terms and Conditions at any time without prior notice, if in its sole discretion, it believes that the Consumer Promotion cannot be conducted fairly or as specified due to any unforeseen circumstances, technical issues, or any other legitimate reason. Any such changes will be communicated through official channels.
  2. No Responsibility for Product Condition: Hemas Manufacturing (Pvt) Ltd expressly disclaims any and all responsibility or liability for the condition, quality, merchantability, fitness for a particular purpose, or any other aspect whatsoever of any of the products or gifts provided as prizes in this promotion, including but not limited to the vehicle, washing machines, televisions, laptops, irons, and smartphones. All prizes are provided “as is” and without any representation or warranty from Hemas Manufacturing (Pvt) Ltd.
  3. Vehicle Registration: The registration of the Grand Prize vehicle (Motor Car) will be undertaken directly by the vehicle manufacturer or its authorized dealer. Hemas Manufacturing (Pvt) Ltd will facilitate the initial coordination but shall not be responsible for the actual registration process, timeline, or any associated costs or delays. The prize winner shall be responsible for providing all necessary documentation and information required for registration and for any subsequent transfers.
  • Warranties and Manufacturer Claims: All warranties, guarantees, after-sales service, and any claims regarding defects, malfunctions, or performance issues related to any of the prizes (including the vehicle and all other products) are solely the responsibility of the respective product manufacturer or the consumer brand provider. Hemas Manufacturing (Pvt) Ltd shall not be liable for, nor shall it be involved in, any warranty claims, repairs, replacements, or customer service issues concerning the prizes. Participants and winners shall deal directly with the relevant manufacturer or consumer brand provider for all such matters.
  • Hemas shall not be liable for any loss, damage, or injury sustained by any participant or winner as a result of participating in this promotion or accepting any prize, except where such liability cannot be excluded by law.
  1. This Consumer Promotion and these Terms and Conditions shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising out of or in connection with this promotion shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
